It could lead to award of damages if the cost incurred from the misrepresentation is substantial.

Also side note, it would have to be a 'fraudulent' misrepresentation in which it can be proven that the other party knew what they were saying was blatantly untrue.

But all of the above may not be relevant, if no contract was ever signed. Misrepresentation cannot be claimed unless it swayed a party into signing a contract.
