Best player we have signed for years and we have lost every game since he walked but I don't want him back now because he let his team mates and us supporters down shamefully.

Not being paid is totally unacceptable and I wouldn't work for free but he could and should have waited until the end of the season.
If you wouldn’t work for free, why should he?
 
I think the club has a point in appealing.
Would we want a precedent where players just walk out when things go askew?
I agree with a lot of comments that suggest Lopata will get a decent club in the summer, no matter the outcome.
So, why ruin his reputation and standing with a club who pushed the boat out to bring him here?
Note, as most have done, how our fortunes dipped when he left.
It clearly has had an effect on our remaining players.
And although I haven't seen the tweet when he supported Brunt's midweek antics, that's a terrible shame and says something about his character we probably don't want to hear.

PS. Agree, crude language is a norm on football forums etc, but wonder if shouted at a game in front of kids, whether those close by, parents, for example, would be as tolerant?

I lived in Southend for more than 25 years up until the mid 80s but I was obviously fortunate in my circle of acquaintances that I rarely encountered the boorish, semi literate oafs that seem to be in plentiful supply now.

There’s no rules when it comes to grammar on the internet. Cute that you think you can correct me though.
 
What pay out?
He was up to date with wages when he ‘resigned’. The appeal is so we can get a fee for him from his new club Isn’t it?
Usually a player will agree a signing on fee that gets paid out across the life of the contract. If the player submits a transfer request they forgo any outstanding amount. Maybe the appeal is whether the club are liable for any remaining signing on fee if the player opts out?
 
Believe it's simply an 'ombudsman" style review of the appeal we already lost. Very much doubt a different result will emerge unless new facts come to light, which I don't think will be the case.
I'd suggest it's not anything more than a nothing to lose thing to do.
