Dale farm evictions "may breach human rights"

So, at around 2 p.m. this afternoon the final ruling is expected that will see if the council can proceed with the evictions or not. As far as I can tell, it seems to hinge on some technicalities so I wonder if the judge, after all his time deliberating, will come up with the common sense decision that, whatever else has gone on and whatever "technicalities" these people want to hide behind, the fundamental truth of the matter is that they have made home illegally on an area that was not designated to be lived on and which they clearly knew at the time they purchased it.

I will be keeping my fingers crossed that on this occasion the law is not the *** it so often seems to be.

Im sorry but technicalities of law are essential , they are how law is processed and put into action , the council failing to make sure the original eviction order included permanent structure's is a technicality (had they done so before it would have been illegal ) . Educated interpretation is what we want.

Oh Sheldon cooper how i long for your words of pearly wisdom.

No it's not. I don't want anyone interpreting the laws of this land. It's either legal or it's not. There is mitigation, there are technicalities and arguments for and against but what there isn't is interpretation of what is passed in to law in this country.

Is that what's called "laying down the law?":winking:

FACEPALM .... that's how they do it , precedence are set by the use and interpretation of the statute of law by the legal profession . It has never been simply one or the other in the most obvious of cases . Mitigation is based on circumstance , and is a form of interpretation.

Oh Sheldon cooper how i long for your words of pearly wisdom.
Except for you've broken your own joke Sheldon is a high functioning autistic (almost savant ), even pretending he dispenses wisdom (which the character never does just facts and answers ) for sarcasm, means your ignorant of your own joke.

I mean repeating the same joke again and again and again , I mean who would keep repeating the same point (Sheldon is a fictional character, most likely with autism) but caught in the same tired stereotype that social interaction and skills take precedent , (as without the social re-enforcement of said stereotype, people may feel inadequate ) over percieved extremes of one form or the other.

Oh sheldon i am ignorant as charged but i know what i am and i am not joking as im not a funny person and hold my hands up to that one.
Gypos as a rule move onto land and get moved off,so after the eviction surely they will just come back after a week or so and it all starts again.

Rule 1 of sarcasm , make it funny and relevant or its just a private joke.
(My reply was in the tone of Sheldon btw so you can't even recognise the character :P )

But once precedence has been set that law is not then open to interpretation.

The gypo's at Dale farm broke the soddin law. What part of your holier than thou intellect can't grasp that simple and inescapable fact. It was, and has always been green belt land. The drains on society down at Dale Farm that masquerade as bona fide gypsy travelers have NEVER been granted planning permission to build on the land they now inhabit and thus have been and are breaking the law. Christ, it's not rocket science is it.

You can go back and forth about what the council should have down 10 years ago but failed to until hell freezes over. The law they broke back then by putting their homes and building dwellings on the land was the same one they are breaking now, nothings changed. If they were good for eviction back when they moved on to the site they sure as hell are now.

Again not the case as precedence's have been know to change or as you already stated other mitigation can cuase review or even change of the law itself . Oh and im not arguing they haven't broken the law you just assumed I have . I was arguing the Basildon council have made an arse of this and the original eviction order was illegal (as stated by the high court who called both parties back to look at the appeal ) . So actually like Basildon council you just have your fact's wrong. If we use your version of law breaking all applications of law are straight black and white no appeals are ever allowed and anyone who had a vague understanding of an extremely complex system would be able to do what ever they like (which is what many are claiming both sides have done ). Also the Echo produced photos last week showing which side were there legally and which were not (it's pictures their easy to follow ).

See I used my intellect checking fact's , not just expressing my opinion thinking it was fact. You see what I've done there . Or not you appear quite simple I can do diagrams if you like ?
Also angry opinion is still opinion.

Very condescending.
Are you and Barna some sort of tag team?

But unlike Osy, Barna isn't a patronizing p****............and in case that didn't get past the swear filter I said P ****!

Like as not Basildon Council have almost certainly made an "arse" of this. However it's the old chicken and egg scenario, in what came first. If the inert travellers hadn't moved on to and built structures and put caravans on to what ostensibly is green belt land without permission or legal right this situation would not have occurred.

I hope you weren't holding your breath

From the echo http://www.echo-news.co.uk/news/9288439.No_Dale_Farm_judgment_today/

There will no no judgment over the Dale Farm eviction at the High Court today.

Judge Mr Justice Ouseley postponed delivering his judgment set for 2pm today, Wednesday, until an undisclosed later date.

Totally agree , they knew full well what they were doing (as the legal site was already there ) , but Basildon council have made a rod for themselves , could have nipped it in the bud , but made a total arse of the situation.

And you are mistaking your opinion for fact , you are producing idiotic statements ergo you are even for the moment an idiot .

No, only to be expected really. Let's waste even more tax payers' money than has already been wasted, let's blight people's lives more than they have been blighted already. Joke.

Osy, I really don't give a fig whether Basildon Council have done this right or wrong, if the bloody travellers hadn't done what they did in the first place, they wouldn't have HAD to do anything. It's the first, illegal actions of the travellers that have precipitated everything that's followed since.

Ive already explained my position on that
