Breaking News WUP Court Hearing - 4th October- Case Dismissed.

There is a lot of misconception about Administration on here. The WUP does prevent the Company or Directors appointing an Administrator without the consent of the Court. What it does not do is prevent the holder of a relevant charge appointing an Administrator. As we all know RM controls the companies who hold charges over the Company. In effect RM could still place the club in Administration.

There will not be a pre pack sale in Administration. The membership of the league and FA can only be transferred with the consent of the league and FA. Nobody is going to buy the club without knowing any conditions on the transfer of the registrations. That is not going to be known in the next 14 days.

No football club has done a pre pack Administration before and SUFC is not about to be the first.
What would need to happen is the club would need to state the intent to go into administration with an agreed buyer in place (effectively pre-pack). The league would need to agree to the new buyer and terms and then the administrator would be appointed.

Bit of a dance, but the administrator cannot fund an insolvent business whilst a sale process is completed. I would call it a pre-pack but whatever description we give it, substance over form that's what it would be? My opinion anyway.
 
Think there was also a quote stating Ron as saying the club won't be sold within 2 weeks. Seems to be an answer to fit any narrative you want to believe at the moment.
Must admit, the comment suggesting JR is going to make a statement did make me immediately think he was pulling out given that's kinda what happened with kimura recently. Big gulp, so encouraging to see posts to the contrary.
RM said he was going to make his own statement, guess what?!? he lied!
 

Both stories reference £2.5m of debt. Ron hasn’t written off all the rest he owes yet has he?
 
What does it say?
An energy company has issued a statement today confirming it is taking action against Southend Uniter over "unpaid energy debts".

Southend United was hauled back to court on Tuesday (September 19) in a dispute with the club’s energy supplier.
A civil hearing was listed at Basildon Magistrates’ Court in a bid to gain access to the stadium, clubhouse and kitchen at Roots Hall.
Southend United chairman Ron Martin attended court for the brief hearing where an “application for warrant of entry” was due to be heard. However, the hearing never started.
Today, a spokesman for npower Business Solutions, part of E.ON Group, said: “We can confirm we are taking action against Southend United Football Club for unpaid energy debts but we cannot comment further while legal proceedings are under way.”

The next listing for the civil case will be at Chelmsford High Court on October 3.

Serious concern surround the future of the club who have until the start of October to pay off their debts to HMRC or be wound up.
Blues fans will be holding a protest march against the club's chairman on Saturday. A number of supporters will be walking from Pier Hill at 1.30pm on Saturday before making their way to Roots Hall for the match with AFC Fylde.
 
Will be interesting to see what happens on Tuesday 3rd October wont it.

Bailiffs/nPower workers I guess will again be waiting to shut the power off at RH, pending the judgement, just before we kick off v Oxford City.

Will the lights go out for one final time? ☹️
