Have just had a quick look on Companies House and the "Insolvency History" tab which is normally not on a company record has appeared on the "Southend United Football Club (The) Ltd" record.

I'm hoping that this is just as a result of the Winding Up order applied for by HMRC, but, on the surface it doesn't look good.

Errrm I'm not sure that is the case. Having done some companies searches in the past as an intern at city law firms, if I remember correctly insolvency history is one of the tabs that you find when you do a complete companies search and is often blank (and expected to be so) when the club has not had any insolvencies in the past.

I'm sure there are others on here who are more knowledgable than I am in these matters but I wouldn't be too concerned about this particular thing, as scared as I am for the club's future :(

Except if you look at a random sample of companies, the only ones with the Insolvency tab showing are those that are in administration or who have been insolvent at some point.

I know my own company doesn't have an insolvency tab showing.

Having seen a post on a bumped thread if the winding up order is succesful, we will be put into Liquidation and not administration.

The only way we will go into Administration would be for RM to put us into Voluntary Administration before wednesdays hearing . Adminstarion prevents further legal avenues for debt recovery , but I am unsure how it works with ongoing legal processes

Smiffy, I believe that the court case is the result of HMRC not accepting time to pay arrangements. Therefore, we can apply for more time, but will need to get it in by Tuesday evening. Otherwise the court case will be a formality...

Not necessarily, because the invoices raised by other parts of the project are likely to be in the name of the holding companies and not Southend United Ltd, all of which are solvent.

Exactly class, it's most likely to be SEL doing the work seeing as they'll own the ground.

I guess that no stadium = more shops and a bigger hotel, and less traffic concerns

Exactly - unfortunately this is all one big rubber stamping. I'm guessing the only way it will get overturned at court (if something not agreed beforehand) is if we can prove HMRC have acted negligently in some way.

Of course, if this is what we are relying on, we would have raised it last time rather than requesting an adjournement.
