Breaking News WUP Court Hearing - 4th October- Case Dismissed.

Probably in case some minor creditor (relatively) suddenly tries to be clever and try to join the petition in an attempt to get paid in full. Creditors shouldn't be allowed to join a petition without giving certain notice in my opinion. But its just one broken process amongst many.
This was precisely the reason things were only announced yesterday, work going on behind the scenes to ensure this didn't happen.

Anyone know when the embargo can be lifted? Does this dismissal open the door for that or is there more debt that means the embargo stays in place?
 
It would be nice if we got a statement from the club this week, before Saturday on where we stand regarding the lifting of the embargo.

Heard a rumour, can't substantiate it in any way, that because Powell is out injured we might be bringing in a replacement in for him in the squad of 16, before Saturday.

Obviously if we get the embargo lifted, Powell and the other injured players are re-instated into the squad and those out of contract can complete the signing of new contracts, as they clearly want to stay, otherwise they could have walked long before now.

Exciting times to be a Shrimper now.....hopefully.

I would have thought there is more HMRC debt and that the agreement is that HMRC won't start yet another WUP and new owners will pay once sale complete. In which case it would be lifted on or around 1st November.

It’s possible although unlikely that HMRC will have to bear the costs.

For instance in a County Case unless Judgment is awarded then the costs aren’t payable by the defendant irrespective of the validity of the claim.

As I said it’s unlikely simply because judges rule on a case by case basis

If there is an agreement to say pay arrears on 1/11 then in accordance with NL rules a TTP has been agreed & is in place and that possibly will satisfy that rule.

No idea re Football Creditors so that could put a spanner in the works nor the situation re overdue accounts .

It will be a concern now how the NL view the failure to pay HMRC in accordance with their statement and I suspect something will be incoming now the re isn’t a WUP in place.
