Parking Fine & how to get off it

Who has issued the fine? Only the police can issue a fine against a breach of the Road Traffic Act.

If it is anybody else, it is a civil case against you. They have to prove beyond reasonable doubt that you parked the car. They won’t have photographic evidence that it was you, they just have the picture of the car and they make enough money from people paying up on first letter.

Best thing you can do is write to them, explain that you weren't driving and ask them not to contact you again. It’s not a case of if you don’t pay, you will get points on license or you car will be crushed into a small cube. The fine has been issued against you; it is down to them, to prove in a court of law that you were driving. Not up to you to prove you’re innocent.
 
So if you need to drop something off at somebodys else & they happen to live in a street where a money grabbing local authority have implemented an unpopular parking system to offset they're not able to raise Council Tax and you turn up to find the street deserted and a perfectly good space outside their flat and you know you'll be approximately 10 minutes, you WOULDN'T park there? Get real!

Happily, if you're stumping up the £60.

As far as I'm concerned I fulfil one of the 6 exemptions under the Road Traffic Act they are prepared to consider, therefore I now fully expect to get off. If not & I have to pay, I'll ensure I'm as much of a pain to their sad little lives as possible by arranging to settle the debt at £2.50 a month or something equally as pointless!
 
Basically, I was dropping some stuff off I'd sold on eBay and was only in the place for 10 minutes. This was 8.30pm on a Monday night & the road was in no way full of residents cars. I had no ticket on my windscreen & so this is the first I've heard about it.

On the one hand you do say it was 10 minutes - personally I'd say that length of time goes beyond dropping off and becomes parked - and even though it was at 8:30 really doesn't matter if the restrictions are still in force. However, on the other hand, the lack of ticket at the time would be rather annoying.

Bottom line, if there's parking restrictions in force and you've parked then it really sounds like tough luck.

Having said that, are there restrictions on unloading? Aren't you only deemed to have 'parked' if the engine's been switched off? (or am I making that up - dunno!). If so then could try claiming the engine was still running. Just a thought.
 
Sadly I believe the myth/loophole about having to pop the ticket on your windscreen was resolved a couple of years back (I can't be certain of this, just something nagging my mind). I believe even a photo, whether CCTV or from a traffic warden is sufficient evidence to warrant a ticket. Still worth investigating and you're not the only one that's been hit with a pointless fine (and 3 points) for marginally breaking the law on deserted roads on a late night.
