Leeds United - Points Deduction Appeal

Yorkshire Blue, John Ryan has to put it bluntly got balls, if he says he will something he will do it, he has taken Rovers from nearly folding to edge of the CCC, he took on the council and got a new stadium, he sacked one of most successful managers and poached a manager who he thought would take Rovers to the next level. He will take action against Leeds alone, if he has too, plus he is well respected amongst other chairmen as to his efforts at Rovers, and will get some of their support. Despite being 2nd and 3rd Rovers and Carlisle have a great affinity, so my guess they would support any action John Ryan would take.

I know John Ryan personally, and his Brother, via their law firm and can categorically state that he is a man that you would not mess with. He would not have to find an expensive lawyer, he is one! He would lilley have access to a very top Barrister who would cut him a deal to take a high profile case with good propsects of success....someone like Andrew Popplewell QC would jump at the chance to run a case like this. However for Ryan to get involved, Rovers would need to be in a position where they would lose out in the event that Leeds recovered some points. IE if Leeds got all 15 back then Rovers would not go up automatically. This might influence the leagues decision as to how many points to give Leeds back. If they reduced the penalty to 10, that would not affect Rovers, just little old Southend, Walsall, Orient and Tranmere. Time will tell but I can imagine that the League will most likely affirm the punishment. The Courts can only intervene if there has been a legal wrongdoing, which can only be by negligence or Breach of contract. We do not profess to know the ins and outs of the leagues contract with the clubs but therein lies the battlefield.
 
It's also worth pointing out that Orient have already stated that, if Leeds were to regain any points, they would appeal against the decision, prolonging the case beyond the end of the season...
 
A Frivolous appeal...

Were Leeds to get ANY points back I would really lose some interest in pro football...I suspect that they will be unsucessfull and I would dock them more points under the infamous " Frivolous appeal " system.
The way I see it is they signed up to a deal for retrieving their golden share, and now they think they can change the deal!...Amazing cheek of dirty Leeds
 
For those unaware of the reasons for the initial deductions. I think 'sedgred' on the forest board summed it up pretty well.....

quote '10 points for failing to come out of administration according to football league rules...............all creditors had not been satisfied.

5 points for financial irregularities to do with accepting season ticket money for the new season with the company in administration and squirreled it away in a new account which at that point in time did not come under football league regulations, but kept it away from creditors though.

Then signed an agreement which stated that Leeds Utd accepted this punishment and would take no further action against the league.' end quote.
 
Not likely to affect us much now but it will mke a huge difference to the automatic promotion places. Leeds with the 15 points back would be level with Carlisle and Swansea who celebrated promotion yesterday would suddenly find they are not promoted yet.
Giving Leeds back those points could cause League One to become a real joke. Don't know if they could increase the points deduction at the appeal(EaSTWOOD had his ban increased to 4 games from 3 when we appealed his sending off) but it would be funny if they did.
 
I just wonder how watertight an agreement under duress can be, though? Leeds didn't really have any alternative to signing if they wanted to stay in the league, a legal contract or agreement has to be fair and reasonable, and I am pretty sure that their first arguement will be that that agreement should be set aside on the grounds that they were railroaded.
 
I would think they will almost ceratinly get back at least 5 of the 15 points. I wouldn't be at all surprised if they get them all back. I think this is more to do with them being called LEEDS UNITED rather than for any other reason. Were it any of the other 23 teams in the league (posssibly Forest aside) there's be no chance of getting the points back.

We would probably be docked more for the appeal.
 
If anybody can get a copy or extract from yesterdays Leeds programme, they will be able to read Bates' rant/reason for why Leeds feel they will or should win.Five Live were talking about it yesterday & IF Bates is to be believed, then the FL are about to be proved to be a big joke again.

A lot of the action, I think, revolves around getting competitors voting on the punishment. It just can't be allowed. I think the phrase used at the time was, "asking turkeys to vote for Christmas!"
 
All the ins and outs of the story are clearly complicated and I don't see how , from our limited knowledge , we can say one way or the other who is right and who is wrong .

What worries me more is that the FL have taken so long to get this sorted and have chosen to have this matter heard behind closed doors - one reason that has been suggested for this is that it will be harder for any other club to challenge the decision ( and presumably by leaving it late less clubs can claim they were affected by any decision which might favour Leeds )

Bates has apparently included transcripts of conversations with FL officials in his submission which it is maintained will be highly embarrassing to the FL if they were to see the light of day .

I certainly don't feel this will be an ' open and shut ' case - but I do fear a cover up .

I think the late, and not so great, Robert Maxwell also helped us out in our darkest hour.
It much actually be to our benefit if Leeds do get all their points back and go up automatically. They are an in-form team at the moment and the one I would least like us to meet in playoffs.
