HMRC law change?

Don't think it will ease the process, or even increase HMRC's appetite for winding up orders. Just simply them being aggrieved at an industry-specific law that's not in place in most other industries - fair enough really. If I was owed money by a club I'd be aggrieved at this law too.
 
I think that if we get hauled into court again by the Taxman that will be it. The End.
So no more "withholding money because the Taxman has made a mistake " please Ron.

I'd be genuinely shocked if we were wound up the next time we were hauled before the Court.

The Courts give every opportunity to pay, even to serial defaulters.

I had 2 people in the Court listening to proceedings the last time and they were convinced the Judge was going to wind us up after the speech from the HMRC's legal team. I would not be at all surprised if we were wound up.

No Recorder is going to give a "there there never mind, don't worry about it" speech. But if you look at all the football clubs which pass in front of these courts year after year, it is very rare indeed that any of them are wound up - even clubs which have worse records and bigger debts than ours are given chance after chance.

And why would RM let us be wound up when going into Administration is a far better option from his point of view?

I think there are some of us who would be very interested in what would surface should we ever go into administration. I dont care how many times we are told it's all due to the slump, our club has been run appallingly by one man who seems to be getting more out of his depth by the month........and is taking us down with him. There appears to be no 'Plan B' and that is very scary!
 
It still beggars belief that there are people who think because clubs haven't been wound up in the past, it follows that we won't be. We are hanging by a thread, and if (probably WHEN) we are up before the Windesrs Court again, it will be very 'touch and go' - with my money on Touch.

Why? We are talking precedent here, which is important in legal cases. I am not saying we won't be - I am saying things have to be very bad before a court will do it, whatever they may say. I actually base my belief that we won't be wound up on the probability that RM would go for Administration first, which is clear in my post.

Since the scrutiny on pre-packs, I suspect Ron wouldn't be guaranteed the repurchase under administration.

Are we talking laymen or people who are legally qualified?

Juries return different verdicts to magistrates.

Whilst we are a serial defaulter, Ron can turn round and say "I told you we'd pay last time and I was good for my word, I'll be good for my word again."

The High Court judge is going to give him that opportunity at least once more.

More to the point, HMRC would give them that opportunity. If Ron came in to another winding up hearing with a cheque, I'm sure that HMRC would be willing to accept and do anything to stop the winding up, even if the judge is embarking on the moral crusade that some are suggesting here.
