The Business
It occured to me the other day that I have never ever made a citizens arrest. I saw a bloke give his Mrs a jab the other day just as the train was pulling out of Brighton station and its got me thinking that it would be quite nice to make one so I have added it too my list of things to do before I die.

I was just wondering if any other Szoners have either made or seen a citizen make a citizens arrest?
 
I have never seen or made a citizens arrest but it I have been arrested.

That gives me an idea for another poll.
 
Citizens arrests are actually are rare thing.
A member of the public is only allowed to arrest someone who is in the act of commiting an indictable offence.
It is really only applicable to store detectives and shop staff detaining people in the process of stealing items from the store.
DTS your example of some bloke giving his missus a dig, if it was just one punch then it could be argued by the time you get to him the arrest would be unlawful. If it was a sustained attack or barrage of punches then that may be different. Unless the actual assault only amounted to a common assault in which case as common assault is not indictable would also make the arrest unlawful.
I am boring myself now and am I sure you all wanted to know about this. :rolleyes:
 
I've seen a few - the security guys at the Sainsbury's I worked at made them a few times. They used to shepherd them into a back room once they'd made the arrest and then hold them there with one in the room and one on the door until the police arrived. It was the duty of the chap on the door to trip the suspect up if he tried to escape, which was always quite comical.
